1. Acceptance and eligibility
By accessing the Services, creating an account, checking an acceptance box, or completing a purchase, you confirm that you have read and agree to these Terms, the Privacy Policy, and the Refund Policy. If you act for an organisation, you represent that you can bind it.
You must be at least 18, able to enter a contract, and legally permitted to use automated trading software and related Services where you live. Do not use or purchase the Services if you do not agree.
2. Nature of the Services and material trading risk
GoGoAI provides software tools, technical content, licensing, and support. We are not a broker, exchange, fund manager, custodian, or investment adviser. We do not hold client funds, decide trades for you, or guarantee any investment result.
Foreign exchange, gold, CFD, and leveraged trading can cause rapid and substantial loss, including loss of all trading capital and, for some products or jurisdictions, additional liability. Historical, backtested, simulated, demo, or third-party-verified results do not predict or guarantee future performance. You must make your own assessment, test settings, select your broker, and accept all trading decisions and risks. Seek independent licensed advice where appropriate.
3. Accounts and security
- Provide accurate, current information and protect your account, password, email, devices, and API or trading-platform credentials.
- Do not share accounts, impersonate anyone, bypass verification or licence limits, or allow unauthorised use.
- Notify us promptly of suspected unauthorised use. Activity performed through a reasonably authenticated account may be treated as yours, except where applicable law provides otherwise.
4. Software licence
Once applicable fees are paid and while you comply with these Terms, we grant a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence for personal or internal business use under the purchased plan. Duration, covered products, MT4/MT5 platform, and trading-account or device limits are those shown on the purchase page, receipt, account entitlement, and licence information we issue.
Except where mandatory law expressly permits, you may not copy or distribute the software; share files or licence credentials; resell, rent, or sublicense; remove rights notices; reverse engineer, decompile, seek source code, bypass access controls; or use the Services to build a competing product. Reasonable archival backups are permitted and remain subject to these Terms.
5. Acceptable use
- Do not use the Services unlawfully, fraudulently, for infringement or harassment, market manipulation, or evasion of financial or sanctions rules.
- Do not upload malware, disrupt or overload systems, probe unauthorised data, abuse payments or refunds, create false accounts, or automate extraction of protected content.
- Do not represent that GoGoAI, any broker, MetaTrader, or Myfxbook guarantees profit, endorses your trading service, or has a partnership with you unless confirmed in writing.
6. Prices, payment, taxes, and refunds
The price, currency, duration, and plan contents shown at checkout control. Stripe or payment providers may perform identity, fraud, and payment-authorisation checks. You authorise the displayed charge and are responsible for applicable taxes, conversion differences, and bank or payment-provider fees unless checkout expressly states otherwise.
GoGoAI's 14-day money-back guarantee and request process are set out in the Refund Policy, incorporated into these Terms. A refund may immediately revoke related entitlement, licence, and download access. Nothing limits a non-excludable statutory refund or consumer right.
7. Updates, availability, and third-party platforms
We may provide fixes, version updates, parameter guidance, or security changes, and may reasonably modify, suspend, or discontinue functionality. Unless an express service level applies, the Services are provided as available and may be interrupted by maintenance, networks, providers, or market events.
The software depends on MetaTrader, operating systems, VPS services, brokers, networks, devices, and third-party APIs. GoGoAI does not control third-party pricing, spreads, execution, leverage, trading restrictions, updates, outages, or account decisions. You must verify compatibility and comply with third-party terms.
8. Intellectual property and feedback
All rights in the Services, software, algorithms, interface, text, images, videos, marks, and documentation belong to GoGoAI or the relevant owner. These Terms grant only the limited use rights expressly stated and transfer no ownership.
You may provide feedback voluntarily. We may use it without charge to improve the Services, provided we do not identify you or disclose your confidential information.
9. Suspension and termination
We may suspend or terminate accounts, licences, or access if we reasonably believe you breached these Terms, payment was reversed, use creates security or legal risk, a licence expired, or law requires it. Where reasonably practicable, we will give notice and a chance to remedy; serious fraud, infringement, or security events may be handled immediately.
On termination, stop use and delete software copies. Payment, intellectual-property, risk, liability, dispute, and other provisions that by nature should survive remain effective.
10. Disclaimers and limitation of liability
To the maximum extent permitted by law, the Services are provided "as is" and "as available". We do not promise uninterrupted or error-free operation, compatibility with every broker, any particular return, or avoidance of loss. Settings, data, content, and support are not personalised investment advice.
To the maximum extent permitted by law, GoGoAI is not liable for trading losses, lost profit or opportunity, lost data, broker or platform conduct, or indirect or consequential loss. For other claims arising from the Services, our total liability is capped at the amount you actually paid for the affected Service in the 12 months before the event giving rise to the claim. The cap does not apply to fraud, wilful misconduct, death or personal injury, or another liability that law prohibits us from limiting.
11. Governing law, disputes, and changes
These Terms are governed by Hong Kong SAR law, without prejudice to mandatory consumer protection in your place of residence. The parties will first try in good faith to resolve disputes through the contact below. Unresolved disputes are subject to the non-exclusive jurisdiction of Hong Kong courts.
We may update these Terms for Service, risk, or legal changes. Material adverse changes will receive reasonable advance notice and apply prospectively. If you disagree, stop future use. An invalid provision does not affect the remainder, and failure to enforce a right is not a waiver.
